En todo lo relativo a menores rige el principio del interés superior del niño, y el juez puede apartarse de lo pactado si perjudica a los hijos. La pensión alimenticia se fija en proporción a las posibilidades del deudor y a las necesidades del acreedor, y puede garantizarse con hipoteca, depósito o descuento vía nómina.
Cuando uno de los cónyuges es extranjero, vive fuera del país o el matrimonio se celebró en el extranjero, hay que atender a la competencia, al domicilio conyugal y al reconocimiento internacional de la sentencia; conviene revisar además efectos migratorios y patrimoniales transfronterizos.
