En sede civil, mediante la acción de responsabilidad civil por daño patrimonial y moral contra el médico o el hospital; en sede penal, por delitos como lesiones u homicidio culposo derivados de impericia, negligencia o inobservancia de deberes; y en sede administrativa, contra instituciones públicas (IMSS, ISSSTE, Secretaría de Salud) mediante la responsabilidad patrimonial del Estado. Un elemento clave es acreditar la relación causa-efecto entre la actuación del profesional y el daño, para lo cual el peritaje médico y el expediente clínico son determinantes.
El consentimiento informado es un deber central: el paciente debe recibir información clara sobre diagnóstico, riesgos y alternativas, y otorgar su autorización por escrito para procedimientos de riesgo; su ausencia o deficiencia es fuente frecuente de responsabilidad. La CONAMED ofrece una vía no jurisdiccional gratuita de orientación, conciliación y arbitraje entre pacientes y prestadores, útil para resolver sin litigio, aunque sus laudos son voluntarios.
En el ámbito sanitario, la COFEPRIS regula y verifica medicamentos, dispositivos médicos, insumos, alimentos, establecimientos y publicidad, y puede imponer sanciones, aseguramientos y clausuras. El abogado médico-sanitario asesora a pacientes que buscan reparación, a profesionales y hospitales en su defensa y prevención de riesgos, y a la industria de la salud en registros y cumplimiento ante la COFEPRIS.
