Civil attorneys in Mexico

Civil law governs contracts, obligations, property, and the financial relationships between private parties. A civil lawyer drafts and enforces contracts, collects debts, resolves disputes over property and liability, and represents your interests when an agreement is breached or a financial right is in dispute.

Civil law is the trunk branch of private law: it governs persons, family (in many states), property, ownership, successions, contracts, and obligations. In Mexico each state has its own Civil Code and its own Code of Civil Procedure, in addition to the Federal Civil Code for matters of federal jurisdiction, so the field is predominantly a state one.

Civil lawyers handle the performance and rescission of contracts, the collection of debts (cobro de pesos), the recovery (reivindicación) and adverse possession (usucapión, prescripción positiva) of real property, easements and boundaries, civil liability for breach, the nullity of legal acts, possessory interdicts, and ordinary and special proceedings.

Fundamental concepts include freedom of contract (autonomía de la voluntad), contractual good faith, the theory of obligations (to give, to do, not to do), default (mora), damages and losses, prescription, and lapse (caducidad). A well-drafted contract from the outset prevents most litigation.

This field constantly intersects with family, commercial, and real-estate law. For example, a breach of a real-estate sale may be resolved through civil channels, whereas the same transaction between merchants could be commercial.

Proceedings may be oral or written depending on the state and the amount in dispute. When the final judgment is unfavorable and the ordinary remedies such as appeal are exhausted, the direct amparo (constitutional relief) lies to review the constitutionality and legality of the ruling.

Process and timelines

The proceeding begins with the complaint; then come service of process and the answer (normally nine days in the ordinary track). Next come the offering and taking of evidence, closing arguments, and the first-instance judgment. In oral tracks, much is resolved in hearings. Against the judgment lies an appeal before the Chamber of the Superior Court of Justice and, finally, the direct amparo. An ordinary civil trial may last one to three years counting all instances; special ones, such as the executive proceeding, are faster.

Documents usually required

  • The contract or document forming the basis of the action
  • Official identification of the parties
  • Proof of payment, receipts, or promissory notes
  • Deeds or title documents, if applicable
  • Proof of address
  • Correspondence or messages relating to the agreement
  • Available appraisals or expert opinions

How much does it cost?

Fees are agreed per matter, as a retainer, or as a percentage of the amount in dispute in collection suits. An advance plus payments per stage is common. Some lawyers charge a percentage of what is recovered in collection matters. Drafting a preventive contract costs far less than litigating its breach afterward. Always ask for a written quote.

When do you need this lawyer?

You need a civil lawyer when a contract is breached against you, you are owed a documented debt, there is a dispute over ownership or possession of an asset, or when you want to draft a solid contract before signing it. Also to sue for or defend against civil liability. If the matter is between merchants over acts of commerce, it may belong to the commercial track; a good lawyer will advise you on the correct jurisdiction.

Red flags when hiring

  • Promises to win the case without having reviewed the contract or underlying document
  • Cannot distinguish whether your matter is civil, commercial, or family
  • Suggests starting the suit without analyzing the prescription of the action
  • Does not provide a written quote or explain the stages and remedies
