When a dispute arises, the consumer files a complaint with PROFECO, which summons a conciliation hearing; if there is no agreement, the parties may submit to arbitration, or the Agency may issue a ruling on the debt, which can have the status of an enforceable instrument (titulo ejecutivo). PROFECO also imposes fines, orders advertising to be suspended, and through class actions can defend groups of consumers affected by the same conduct.
The LFPC covers both traditional and electronic commerce, timeshares, non-bank financial services, and warranties, and relies on the Mexican Official Standards (Normas Oficiales Mexicanas) to require quality, information, and safety in products.
