En México es materia federal, regida por la Ley Federal de Protección al Consumidor (LFPC) y aplicada por la Procuraduría Federal del Consumidor (PROFECO), organismo que concilia, arbitra, sanciona y emite normas.
La ley reconoce derechos básicos: información veraz y clara, protección contra publicidad engañosa, respeto a los precios y condiciones ofrecidos, garantías, y protección frente a cláusulas y prácticas abusivas. El proveedor debe respetar los términos, plazos, condiciones y modalidades ofrecidos o pactados; el consumidor tiene derecho a la reposición del producto, a la bonificación o a la devolución del monto pagado cuando el bien o servicio no cumple. En ventas a domicilio, por teléfono o en línea existe, además, un plazo para desistirse (revocación de consentimiento).
Cuando surge un conflicto, el consumidor presenta una queja ante la PROFECO, que cita a una audiencia de conciliación; si no hay acuerdo, las partes pueden someterse a arbitraje o la Procuraduría puede dictaminar el adeudo, que llega a tener carácter de título ejecutivo. La PROFECO también impone multas, ordena suspender publicidad, y a través de acciones colectivas puede defender a grupos de consumidores afectados por la misma conducta.
La LFPC cubre tanto comercio tradicional como electrónico, tiempos compartidos, servicios financieros no bancarios y garantías, y se apoya en las Normas Oficiales Mexicanas para exigir calidad, información y seguridad en los productos.
